1.1 These Terms and Conditions (the "Terms") govern the use of the Mgask app, the mgask.sa website and the associated shop management systems, which are owned and operated by Jil Alitqan Company.
1.2 These Terms constitute a binding contract between you and the Company. You accept them by creating an account, by clicking the acceptance button, or simply by using the Platform, and such electronic acceptance is legally effective under the Electronic Transactions Law of the Kingdom of Saudi Arabia.
1.3 These Terms shall be read together with the Privacy Policy and with any additional terms presented to you when you use a particular service (such as the Tailor Plus subscription form), all of which form an integral part of these Terms. In the event of conflict, the additional service-specific terms shall prevail to the extent of their subject matter.
1.4 Current scope of service: tailoring of men's thobes within the city of Riyadh. The Company may expand the geographic scope or add new services, and will announce any such change through the Platform.
Wherever used in these Terms, the following words and expressions shall have the meanings set out opposite each of them:
3.1 The Platform is an intermediary online marketplace that connects Customers with tailoring shops and organises ordering, measurement-taking, payment and delivery. The Company is not a tailoring shop, does not itself manufacture thobes, and is not the seller of the products offered by Shops.
3.2 The tailoring or sale contract is formed directly between the Customer and the Shop, and the Shop alone is responsible to the Customer for the quality of the fabric and workmanship, the conformity of the thobe with the agreed measurements and specifications, and the time taken to complete the Order.
3.3 Where payment is made electronically, the Company collects amounts from Customers on behalf of Shops, acting as an agent with limited authority for that purpose, and payment by the Customer to the Company shall discharge the Customer's obligation to the Shop to the extent of the amount paid.
3.4 The Company does not guarantee the availability of any particular Shop, product or appointment at all times. It exercises reasonable care to ensure the accuracy of the information displayed; however, product details, prices and lead times are entered by the Shop, which bears responsibility for their accuracy.
4.1 To use the Platform, the User must have full legal capacity and be at least 18 years of age, or must use the Platform under the supervision and with the consent of their guardian.
4.2 The User shall provide accurate and complete information and update it whenever it changes, keep their login credentials confidential, and notify the Company immediately upon suspecting any unauthorised use of their account.
4.3 The User is responsible for all activity carried out through their account. The Establishment Owner is responsible for all acts of its employees, its branches and the users to whom it grants permissions on the Shop's account.
4.4 An account may not be sold, assigned or shared with any third party without the Company's written consent.
The User shall not do any of the following:
6.1 The prices of products and services and any delivery and measurement-visit fees (where applicable) are displayed before the Order is confirmed, and prices displayed to the Customer are inclusive of value added tax (VAT). An Order is deemed confirmed once it has been accepted by the Shop and payment has been completed or an available payment method has been selected.
6.2 The completion and delivery times displayed are estimates and may change for operational reasons. The Customer will be notified through the Platform of any material delay.
6.3 Because thobes are made to order according to the Customer's measurements and specifications, the right of withdrawal provided for under the E-Commerce Law does not apply to them once work on them has begun. Accordingly:
6.4 The Customer shall inspect the Order upon receipt and report any defect or non-conformity through the Platform within 7 days of the date of receipt, attaching photographs illustrating the issue wherever possible.
6.5 If it is established that the thobe does not conform to the approved measurements or the agreed specifications, or has a defect in the workmanship or fabric, the Shop shall alter it free of charge; if alteration is not possible, the Shop shall remake it or refund its price, as determined by the Company after reviewing the case and in accordance with applicable law.
6.6 The following shall not be considered defects: issues resulting from measurements or data entered or approved by the Customer themselves, from misuse or washing, or from changes in the Customer's body measurements after the measurements were taken.
6.7 Amounts due to the Customer shall be refunded to the original payment method within the statutory period, and the time at which they appear in the account is subject to the procedures of the bank or payment service provider.
7.1 Measurements may be taken by a Measurement Specialist sent to the Customer, or at the Shop, or may be entered by the Customer themselves. The Measurement File is presented to the Customer for review before approval, and the Customer's approval constitutes an acknowledgement of its accuracy.
7.2 The Customer shall ensure access to the specified location at the agreed time. If the location cannot be accessed, or if the Customer cancels the appointment at short notice, the visit or rescheduling fees shown on the Platform may be charged.
7.3 Responsibility for the Order passes to the Customer upon its delivery to the specified address or to any person receiving it on the Customer's behalf. The Customer is responsible for the accuracy of the address and contact details.
7.4 The Company exercises reasonable care in selecting Measurement Specialists and Drivers and instructing them to conduct themselves professionally, and the Customer may report any concern regarding their conduct through the Platform.
8.1 To join, the Shop must be a duly established entity holding a valid Commercial Registration that covers tailoring activity and any required municipal or regulatory licences, and the Establishment Owner must provide such documents as the Company requests for verification.
8.2 The Company may accept or reject an application to join in accordance with its operational criteria, without any obligation to give reasons.
8.3 The Shop shall not solicit Customers who reached it through the Platform to complete Orders outside the Platform for the purpose of avoiding the Commission, for the duration of its dealings with the Platform and for 12 months after they end, in respect of Customers it came to know through the Platform. Where a breach is established, the Company may claim the lost Commission, in addition to its right to suspend or terminate.
8.4 The Company monitors the Shop's performance indicators, such as cancellation, delay and complaint rates and ratings, and may on that basis adjust the Shop's visibility on the Platform, issue it with a warning, or take any of the measures set out in Clause (17).
9.1 The Regular subscription plan provides the Shop, without any subscription fee, with: opening and setting up a store, adding products, receiving and managing app orders, measurements for app orders, choosing the driver, and a basic dashboard, for one branch and up to a maximum of 4 employees. The Company is entitled in respect of this plan to the standard Commission specified in Clause (10).
9.2 The Tailor Plus plan includes all the features of the Regular subscription plan, in addition to the features described on the Plans page, including: adding the Shop's own orders and walk-in customers, customer management, order production stages, inventory management, custom products, custom measurements, customisation of the measurement-taking file (PDF), the Establishment Owner dashboard and branch comparison, the full dashboard, customer reports, daily reports and account statements, smart analytics, custom WhatsApp messages, custom design, one photographer visit, advanced technical support, support for migrating to the system, and a reduced Commission. The plan allows up to 10 branches and 40 employees per account.
9.2 bis – The private payment gateway is an optional add-on service available to Tailor Plus subscribers. It is not included in the subscription fee and is priced and activated at the Shop's request as agreed in writing, including by electronic messages. The expiry of this service shall not affect the subscription.
9.2 bis (2) – Under both plans, the Shop shall deliver its Orders to Customers and shall bear responsibility for, and the costs of, such delivery. The Shop may, under either plan, agree with the Company that the Company shall undertake the delivery of Orders and/or the taking of Customers' measurements on its behalf. Such service shall be subject to a separate consideration and to terms determined in the agreement concluded between the parties, and shall not be included in the subscription fee.
9.3 The Tailor Plus fee is SAR 2,600 per year, excluding value added tax, which is added at the statutory rate. It is payable in advance for the full subscription year, the subscription starts on the date of activation, and the Company issues an electronic tax invoice for the amount.
9.4 The subscription renews annually for the same term, and the Company shall notify the Shop at least 14 days before the renewal date. The Shop may stop the renewal at any time before that date, in which case the subscription continues until the end of the paid year.
9.5 The Shop may cancel the subscription and receive a full refund of the fee within 7 days of the activation date, provided it has not benefited from services actually performed, such as the photographer visit, custom design or data migration. After that period, no fees are refunded for the remaining term.
9.6 By way of exception to Clause (9.5), if the Company is unable to provide the essential features of the plan for more than 30 consecutive days for a reason attributable to the Company, the Shop may terminate the subscription and receive a refund proportionate to the remaining term.
9.7 Upon expiry or non-renewal of the subscription, the account automatically moves to the Regular subscription plan and the Shop's data remains preserved. Additional branches and features specific to the Tailor Plus plan are suspended or become view-only until the Shop subscribes again.
9.8 The Company may develop the features of the plans or change their prices. A price increase shall not apply to a subscription term already paid for, and the Company shall notify the Shop of any price change at least 30 days before it applies to the next renewal. The Company may not remove an essential feature of the plan during a paid subscription term without providing a reasonable alternative.
10.1 The Company is entitled to a Commission on every Order fulfilled through the Platform, at the rates notified to the Shop in the dashboard or in the onboarding agreement, and the Commission under the Tailor Plus plan is lower than under the Regular subscription plan. The Shop shall be notified of any change to the Commission 30 days before it takes effect, and no such change shall apply retroactively.
10.2 Online sales amounts due to the Shop are transferred to its bank account registered in the name of the establishment every two days under both plans, in respect of Orders delivered to the Customer, after deduction of the Commission, fees and any amounts owed.
10.2 bis – Private payment gateway (add-on service): when this service is activated for a Tailor Plus subscriber, the Order amount paid by the Customer through the Platform is transferred directly to the Shop's account after deduction of the Commission and fees, without waiting for the periodic settlement date. This remains subject to the procedures of the payment service provider and the banks and to the Company's rights under Clause (10.3), and the Company may temporarily suspend this service for an Order or for a Shop in the event of a dispute, suspected fraud or an unusual increase in chargebacks.
10.3 The Company may withhold the transfer of amounts relating to an Order that is the subject of a dispute, complaint or payment chargeback until it is resolved, deduct from the Shop's Payouts any amount refunded to the Customer, and set off against the Shop's Payouts any amounts owed to the Company by the Shop.
10.4 The Shop is responsible for the accuracy of its bank details, and the Company shall not be liable for any transfer made to an account entered incorrectly by the Shop.
10.5 The account statement in the dashboard shall be binding on the Shop unless it objects to it in writing within 30 days of the date on which it is made available.
11.1 The Shop is responsible for the content of the custom WhatsApp messages that it writes or approves for sending to Customers, and shall send them only to Customers connected with its Orders or who have consented to receive them, in compliance with WhatsApp's policies and the laws governing messaging. The Company may disable this feature in the event of misuse.
11.2 Daily reports are sent to the WhatsApp number and email address registered for the Shop. The Shop shall keep these up to date and restrict access to the reports to its authorised personnel.
11.3 Smart analytics provide supporting suggestions and analyses, which may not be accurate or complete in every case. The Shop remains responsible for reviewing their outputs before relying on them for any decision concerning Orders, measurements, prices or dealings with Customers.
11.4 Custom design is provided as part of the Tailor Plus plan to customise the identity and storefront of the Shop's store on the Platform, within the scope described at activation. The plan includes one photographer visit only during the subscription term to photograph the Shop's products and premises, the duration and scope of which shall be determined at the time of scheduling; any additional visits shall be subject to an agreed consideration. The Shop shall prepare the premises and products at the agreed time, and the visit shall be deemed performed if it could not be completed for a reason attributable to the Shop.
11.5 Ownership rights in the photographs and designs produced remain with the Company, and the Company grants the Shop a non-exclusive, perpetual licence to use them to market its products and services on and off the Platform. The Shop likewise grants the Company the right to use them to showcase the Shop and to market the Platform.
11.6 The Measurement File is the PDF file that the Shop receives after the Customer's measurements are taken, containing all of the Customer's measurements and the Order details. The Tailor Plus plan allows the Shop to customise the content and layout of this file and of the measurement-taking form. The Shop is responsible for the accuracy of the fields and formats it adds, modifies or deletes in the Measurement File, and for ensuring that no measurement required to fulfil the Order is omitted, and the Company shall not be liable for any error in fulfilment resulting from such customisation.
11.7 The Establishment Owner acknowledges that it has legal authority over all the branches it adds to its account, and bears responsibility for the acts of users in each branch.
11.8 The Company assists the Shop in migrating its data to the Platform on the basis of the data the Shop provides. The Shop remains responsible for the accuracy of that data and the lawfulness of its transfer, and for reviewing it after migration.
12.1 Measurement Specialists and Drivers registered on the Platform shall comply with applicable laws and the operational instructions issued by the Company, and shall deal with Customers and Shops respectfully and honestly.
12.2 They shall safeguard the Orders in their custody and deliver them in the condition received, keep Customers' data, addresses and measurements confidential, and not use them or contact Customers for any purpose outside the scope of their assignment.
12.3 The contractual and financial relationship between the Company and Measurement Specialists and Drivers is governed by separate agreements, and these Terms do not create any employment relationship between them and Customers or Shops.
13.1 The User retains ownership of the content they publish, such as product images, descriptions and ratings, and grants the Company a non-exclusive, royalty-free and transferable licence to use, display and reformat it for the purpose of operating and marketing the Platform.
13.2 The User represents that they have the right to publish such content and that it does not violate any law or the rights of others.
13.3 Ratings must reflect a genuine experience. The Company may remove any non-compliant or misleading content or rating, without being obliged to review all content in advance.
14.1 All intellectual property rights in the Platform are owned by or licensed to the Company, including the software, designs, interfaces, databases, the trade name "Mgask", logos, measurement forms and reports.
14.2 The Company grants the User a personal, limited, non-exclusive, non-transferable and revocable licence to use the Platform in accordance with these Terms. This licence does not grant the User any other right in the Platform or its trademarks.
14.3 If the User submits suggestions or feedback for improving the Platform, the Company may use them without any consideration or obligation.
15.1 The Company processes personal data in accordance with the Privacy Policy and the Personal Data Protection Law of the Kingdom of Saudi Arabia.
15.2 The Customer consents to the sharing of their necessary data, such as name, contact number, address and measurements, with the Shop they choose and with the Measurement Specialist and Driver assigned to their Order, only to the extent necessary to fulfil the Order.
15.3 The Shop receives Customers' data solely for the purpose of fulfilling their Orders, and shall protect it and shall not retain or use it after that purpose has been fulfilled except as permitted by law. The Shop is responsible for any unlawful use or disclosure by it or by its employees.
16.1 The Platform is provided "as is" and "as available". The Company exercises reasonable care to operate it without interruption, but does not guarantee that it will be entirely free from errors or interruptions, particularly during maintenance, updates or failures beyond its control.
16.2 The Company shall not be liable for indirect or consequential damages, such as loss of profit, loss of reputation or loss of data, nor for any failure by the Shop to perform the tailoring contract, for which the Shop remains responsible to the Customer.
16.3 In all cases, the Company's total liability to any User shall not exceed: for a Customer, the value of the Order that is the subject of the claim; and for a Shop, the total subscription fees paid by the Shop to the Company during the twelve months preceding the claim.
16.4 The limitations in this Clause do not apply in cases of fraud or gross negligence, nor to any liability that cannot lawfully be limited or excluded.
16.5 The User, and the Shop in particular, shall indemnify the Company and its personnel against any claims, losses, fines or reasonable expenses, including legal fees, arising from the User's breach of these Terms, of the law or of the rights of others, or from the products and services the User provides.
17.1 The Company may suspend an account, restrict some of its features or terminate it in the event of a breach of these Terms or of the law, repeated complaints, delays or cancellations, reasonable suspicion of fraud, or at the request of a competent authority. The Company shall notify the User of the reason unless such notice would prejudice an investigation or constitute a legal violation. In cases of serious breach, termination shall be immediate and without warning.
17.2 The User may stop using the Platform and request the deletion of their account at any time. The Shop may end its dealings with the Platform by giving 14 days' prior notice, while remaining obliged to complete outstanding Orders.
17.3 If a Tailor Plus subscription is terminated due to a breach by the Shop, the Shop shall not be entitled to a refund of any fees.
17.4 Termination shall not affect rights and obligations that arose before it, including Payouts, Commissions and outstanding Orders. The clauses relating to intellectual property, non-circumvention, personal data, limitation of liability and indemnity, and dispute resolution shall survive termination.
Neither party shall be deemed in breach of its obligations if their performance is delayed or prevented by circumstances beyond its reasonable control, such as natural disasters, epidemics, government decisions, or outages of communications, cloud services or payment gateways. Performance shall resume as soon as the cause ceases.
19.1 These Terms are governed by and shall be construed in accordance with the laws in force in the Kingdom of Saudi Arabia.
19.2 The parties shall seek to resolve any dispute amicably through the Platform's support channels within 30 days of notifying the other party of it. If this is not possible, the competent judicial authorities in the city of Riyadh shall have jurisdiction.
19.3 The foregoing is without prejudice to the Customer's right to file a complaint with the Ministry of Commerce or the authorities responsible for consumer protection.
20.1 Amendments to the Terms: The Company may amend these Terms, and the updated version will be published on this page with its date updated. The Company shall notify Users of material amendments through the Platform, email or messages at least 14 days before they take effect, and continued use thereafter constitutes acceptance of them.
20.2 Notices: Notices sent through the Platform, by email, text message or WhatsApp to the details registered on the account shall be deemed valid and effective notices.
20.3 Assignment: The User may not assign their rights or obligations under these Terms without the Company's written consent. The Company may assign them to any of its affiliates or to a successor to its business.
20.4 Severability: If any provision is held to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
20.5 No Implied Waiver: Any delay by the Company in exercising any right shall not constitute a waiver of that right.
20.6 Language: The Arabic text of these Terms is the authoritative text; translated versions are provided for convenience only, and the Arabic text shall prevail in the event of any discrepancy.
Complaints are received through the Platform, by email or via WhatsApp, and the Company undertakes to respond to them within 5 business days of the date of receipt.
