الشروط والأحكام – تطبيق مقاسك (Mgask)

أولاً: التمهيد

مرحبًا بك في تطبيق مقاسك (Mgask)، التطبيق المملوك لشركة جيل الإتقان.

يعمل التطبيق كمنصّة إلكترونية وسيطة تجمع بين:

• محلات خياطة الملابس السعودية الرجالية (ويُشار إليها لاحقًا بـ "محلات الخياطة" أو "الخياطين")؛ و
• العملاء الراغبين في تفصيل الثياب أو تعديلها أو الاستفادة من خدمات الخياطة (ويُشار إليهم لاحقًا بـ "العملاء").

يقتصر دور تطبيق مقاسك على توفير منصة تقنية لعرض محلات الخياطة وخدماتهم، وتمكين التواصل والطلب بينهم وبين العميل، مع إمكانية تنظيم عملية أخذ المقاسات (عن طريق مندوب أو أي وسيلة متفق عليها) ومتابعة حالة الطلب والتسليم.

إن استخدامك للتطبيق أو دخولك إليه يعني موافقتك الكاملة والملزمة على هذه الشروط والأحكام وسياسة الخصوصية وأي سياسات أو ملاحق أخرى يتم الاعلان عنها داخل التطبيق أو الموقع الإلكتروني mgask.sa.

في حال عدم موافقتك على أي جزء من هذه الشروط، ينبغي عليك التوقف فورًا عن استخدام التطبيق وخدماته.

ثانيًا: التعريفات

ما لم يقتضِ السياق خلاف ذلك، يكون للكلمات والعبارات التالية المعاني الموضحة قرين كل منها:

• التطبيق / المنصة: تطبيق مقاسك (Mgask) و/أو الموقع الإلكتروني المرتبط به mgask.sa.
• الشركة: شركة جيل الإتقان، المالكة لتطبيق مقاسك والعلامة التجارية له.
• العميل: كل شخص طبيعي يقوم بإنشاء حساب في التطبيق أو يستخدمه لطلب خدمات الخياطة أو التعديل.
• محل الخياطة / الخياط: أي منشأة أو شخص يقدّم خدمات خياطة الثياب أو تعديلها أو الخدمات المرتبطة بها، ويستخدم التطبيق لعرض خدماته واستقبال الطلبات.
• الحساب: الحساب الإلكتروني الذي يتم إنشاؤه من قبل العميل أو محل الخياطة لاستخدام خدمات التطبيق.
• الطلب: أي طلب خدمة (تفصيل ثوب، تعديل، خدمة إضافية) يقدّم عبر التطبيق من العميل إلى محل الخياطة.
• المندوب: الشخص الذي يتم إرساله – إن وجِد – لأخذ المقاسات أو استلام/تسليم الثياب، سواء كان تابعًا لمحل الخياطة أو لشركة لوجستية متعاقدة أو لأي طرف ثالث مستقل.

ثالثًا: طبيعة عمل التطبيق والدور القانوني

• يعمل تطبيق مقاسك كمنصة تقنية فقط لعرض محلات الخياطة وخدماتها وإتاحة التواصل والطلب بينها وبين العملاء. ولا يُعدّ التطبيق محل خياطة ولا يقدّم خدمات الخياطة بنفسه.
• العلاقة التعاقدية في تنفيذ خدمة الخياطة أو التعديل أو أي خدمة مرتبطة بها تنشأ مباشرة بين العميل ومحل الخياطة، ويقتصر دور الشركة على تسهيل هذا الربط وتنظيمه.
• لا تُعد الشركة طرفًا في الاتفاق بين العميل ومحل الخياطة بخصوص جودة القماش أو التصميم أو الوقت الفعلي لإنجاز الخدمة أو التفاصيل الفنية الأخرى، ولا تتحمل أي التزام ناشئ عن هذه العلاقة، إلا في حدود ما ينص عليه النظام وما يخص دورها التقني.
• في حال وجود خدمة مندوب لأخذ المقاس أو التوصيل، فإن دور التطبيق يقتصر على تنظيم عملية الطلب وتنسيقها، وقد تتم الاستعانة بمندوب تابع لمحل الخياطة أو شركة توصيل أو طرف ثالث مستقل، وتكون مسؤولية التنفيذ الفعلي على عاتق الجهة المقدمة للخدمة।

رابعًا: إنشاء الحساب واستخدام التطبيق

• يشترط في مستخدم التطبيق أن يكون كامل الأهلية النظامية وفقًا للأنظمة المعمول بها في المملكة العربية السعودية، وألا يقل عمره عن (18) سنة، أو أن يستخدم التطبيق تحت إشراف ولي أمره الشرعي.
• يلتزم المستخدم بتقديم بيانات صحيحة ودقيقة وحديثة عند إنشاء الحساب، والمحافظة على سرية بيانات الدخول وكلمة المرور وعدم مشاركتها مع أي طرف آخر.
• يتحمل المستخدم المسؤولية الكاملة عن جميع العمليات التي تتم من خلال حسابه في التطبيق.
• للشركة الحق في إيقاف أو تعليق أو إلغاء أي حساب في حال مخالفة الشروط والأحكام أو أي أنظمة سارية أو في حال إساءة استخدام التطبيق.

خامسًا: الطلبات والدفع والإلغاء

• يقوم العميل باختيار محل الخياطة والخدمة المطلوبة وتعبئة التفاصيل اللازمة (المقاسات، نوع القماش، الملاحظات، طريقة الاستلام، وغيرها) من خلال التطبيق.
• يتم تحديد تفاصيل الأسعار والزمن المتوقع لإنجاز الخدمة من قبل محل الخياطة، وقد تظهر في التطبيق على سبيل التقدير التقريبي، ويُعد السعر النهائي والاتفاق النهائي مسؤولية محل الخياطة والعميل.
• في حال إتاحة الدفع الإلكتروني أو عبر بوابات دفع داخل التطبيق، فقد يتولى التطبيق تحصيل المبلغ لحساب محل الخياطة أو الجهة المقدّمة للخدمة وفق الاتفاقات التجارية، دون أن يغيّر ذلك من طبيعة مسؤولية محل الخياطة عن تنفيذ الخدمة.
• سياسات الإلغاء والاسترجاع – إن وُجدت – يتم تحديدها من قبل محل الخياطة و/أو وفق ما تنص عليه الأنظمة المعمول بها في المملكة، ويتم توضيحها قدر الإمكان داخل التطبيق.
• قد تُفرض رسوم خدمة أو توصيل أو زيارات ميدانية، ويتم توضيحها – قدر الإمكان – قبل إتمام الطلب.

سادسًا: خدمة أخذ المقاسات والتوصيل

• قد يتيح التطبيق – حسب الإمكانية والمدينة – خدمة إرسال مندوب لأخذ المقاسات من العميل أو استلام وتسليم الثياب.
• يتحمل العميل مسؤولية التأكد من صحة المقاسات والمعلومات التي يقدّمها، سواء تم أخذها بواسطة المندوب أو عن طريقه شخصيًا.
• لا تضمن الشركة دقة المقاسات أو مدى ملاءمتها لرغبة العميل؛ حيث إن ذلك يدخل في نطاق الخدمة المقدمة من محل الخياطة أو المندوب (إن كان تابعًا له).
• يلتزم المندوب – إن وُجد – بالتعامل مع الثياب والمقتنيات بعناية، إلا أن أي تلف أو فقدان ينتج عن خطأ أو إهمال يكون مسؤولية الجهة المنفذة للخدمة وفقًا للأنظمة والعقود بينها وبين العميل، وفي حدود ما يسمح به النظام.

سابعًا: التقييمات والمحتوى المقدم من المستخدم

• يتيح التطبيق للعملاء تقييم محلات الخياطة وكتابة الملاحظات بما يعكس تجربتهم الحقيقية، بشرط الالتزام بالأدب والاحترام وعدم الإساءة أو التشهير أو استخدام ألفاظ غير لائقة.
• تحتفظ الشركة بالحق في حذف أو إخفاء أي تقييم أو تعليق مخالف للأنظمة أو الآداب العامة أو يتضمن معلومات مضللة أو مسيئة.
• يقرّ المستخدم بأنه يمنح الشركة حقًا غير حصري ومجانيًا في استخدام وعرض التقييمات داخل التطبيق أو للأغراض التسويقية وفقًا للضوابط النظامية.

ثامنًا: الملكية الفكرية

• جميع حقوق الملكية الفكرية للتطبيق، بما في ذلك الاسم التجاري مقاسك (Mgask)، والشعار، والتصاميم، والواجهات، والنصوص، والرموز، والبرمجيات، مملوكة لشركة جيل الإتقان.
• لا يُسمح بنسخ أو إعادة استخدام أو تعديل أي جزء من محتوى التطبيق أو تصميمه أو علاماته التجارية دون الحصول على موافقة خطية مسبقة من الشركة.

تاسعًا: حدود المسؤولية

• لا تتحمل الشركة مسؤولية أي أضرار مباشرة أو غير مباشرة أو خاصة أو تبعية تنشأ عن:
  • سوء استخدام التطبيق من قبل المستخدمين.
  • أي خطأ أو تقصير في تنفيذ الخدمة من قبل محلات الخياطة أو المندوبين أو شركات التوصيل.
  • عدم التزام أي طرف بالتزاماته التعاقدية أو النظامية تجاه الطرف الآخر.
• يقرّ المستخدم بأن استخدامه للتطبيق يكون على مسؤوليته الشخصية، وأن دور الشركة محدود بتوفير المنصة التقنية فقط.

عاشرًا: إنهاء الاستخدام وتعديل الشروط

• للشركة في أي وقت ووفق تقديرها المنفرد إيقاف أو تعليق أو إلغاء حساب أي مستخدم يخالف هذه الشروط أو يسيء استخدام التطبيق.
• تحتفظ الشركة بالحق في تعديل هذه الشروط والأحكام في أي وقت، ويتم نشر النسخة المحدّثة عبر التطبيق أو الموقع الإلكتروني، ويُعد استمرار استخدامك للتطبيق بعد التعديل موافقة ضمنية منك على الشروط المحدّثة.

حادي عشر: القانون الواجب التطبيق والاختصاص القضائي

• تخضع هذه الشروط والأحكام لأنظمة المملكة العربية السعودية.
• في حال نشوء أي نزاع – لا قدّر الله – حول تفسير أو تنفيذ هذه الشروط، يكون الاختصاص للجهات القضائية المختصة في المملكة العربية السعودية.

1. Introduction

Welcome to the Mgask application (the "App"), owned and operated by Jil Alitqan (the "Company").

The App acts as an online platform that connects:

• Saudi men’s tailoring shops ("Tailors"); and
• Customers seeking to tailor or alter traditional thobes or related garments ("Customers").

The role of the App is limited to providing a technical platform where Tailors can display their services and Customers can place and manage their requests, including organizing measurements and following up on the order status and delivery.

By accessing or using the App, you agree to be bound by these Terms and Conditions, the Privacy Policy, and any other policies or addenda announced through the App or the website mgask.sa.

2. Definitions

Unless the context requires otherwise, the following terms shall have the meanings set out below:

• App / Platform: The Mgask mobile application and/or its related website mgask.sa.
• Company: Jil Alitqan, the owner of the App and the Mgask trademark.
• Customer: Any natural person who creates an account or uses the App to request tailoring or related services.
• Tailor / Tailoring Shop: Any entity or individual that provides tailoring or alteration services and uses the App to display services and receive orders.
• Account: The digital account created by a Customer or Tailor to use the App.
• Order: Any service request (tailoring, alteration, or related service) submitted through the App by a Customer to a Tailor.
• Representative: A person who may be dispatched, where the service is available, to take measurements or collect/deliver garments, whether affiliated with the Tailor or a third-party service provider.

3. Nature of the Service and Legal Role

• The App is a technical platform only. It is not a tailoring shop and does not itself provide tailoring services.
• The contractual relationship for tailoring, alteration, or any related service is formed directly between the Customer and the Tailor. The Company’s role is limited to facilitating this connection and organizing it.
• The Company is not a party to the agreement between the Customer and the Tailor regarding fabric selection, design, quality, or actual completion time, and assumes no responsibility for obligations arising from that relationship, except to the extent required by applicable law and limited to its technical role.
• Where a measurement or delivery service is available, the App’s role is limited to coordinating the request. Actual service may be performed by a Tailor, its staff, or a third-party logistics provider, who shall bear responsibility for their performance in accordance with applicable laws and agreements.

4. Account Creation and Use

• Users must have full legal capacity under the laws of the Kingdom of Saudi Arabia. Users under 18 may use the App only under the supervision of their legal guardian.
• Users must provide accurate, current, and complete information when creating an Account and must keep their login credentials confidential and secure.
• The user is fully responsible for all activities that occur under their Account.
• The Company may suspend or terminate any Account in case of violation of these Terms, misuse of the App, or breach of any applicable laws.

5. Orders, Payments, and Cancellation

• Customers select the Tailor and service, provide required details (measurements, fabric type, notes, delivery method, etc.), and submit the Order through the App.
• Pricing and estimated completion times are provided by the Tailor and may appear in the App for convenience only. The final price and agreement remain between the Tailor and the Customer.
• If online payment is enabled, the App may facilitate the payment process on behalf of the Tailor or service provider. This does not change the fact that the Tailor is solely responsible for performing the service.
• Cancellation and refund policies, where applicable, are determined by the Tailor and/or in accordance with applicable laws in the Kingdom of Saudi Arabia and will be displayed in the App where possible.
• Service fees, delivery charges, or on-site visit fees may apply and will be communicated to the Customer before confirming the Order, where reasonably possible.

6. Measurements and Delivery

• In some locations, the App may offer a service to dispatch a Representative to take measurements or handle pickup and delivery.
• The Customer is responsible for verifying the correctness of the measurements and information provided, whether taken by the Representative or shared directly by the Customer.
• The Company does not guarantee the accuracy of measurements or their suitability to the Customer’s preferences; this falls under the responsibility of the Tailor and/or the Representative where applicable.
• The Representative must handle garments with due care. Any damage or loss resulting from negligence or wrongdoing shall be the responsibility of the service provider in accordance with applicable laws and agreements with the Customer.

7. Ratings, Reviews, and User Content

• The App allows Customers to leave ratings and reviews to reflect their genuine experience with Tailors, provided that such content is respectful and does not contain insults, defamation, or unlawful content.
• The Company reserves the right to remove or hide any rating or comment that violates laws, public morals, or contains misleading or offensive content.
• By posting reviews, the user grants the Company a non-exclusive, free license to use and display such content within the App and for marketing purposes in accordance with applicable regulations.

8. Intellectual Property

• All intellectual property rights in the App, including the name Mgask, logos, designs, interfaces, texts, icons, and software, are owned by Jil Alitqan.
• No part of the App or its content may be copied, modified, or reused without prior written consent from the Company.

9. Limitation of Liability

• To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, special, incidental, or consequential damages arising from:
  • Misuse of the App by users;
  • Any fault or negligence by Tailors, Representatives, or delivery providers in performing the services;
  • Any failure by any party to fulfill its contractual or legal obligations towards another party.
• The user acknowledges that they use the App at their own risk and that the Company’s role is limited to providing a technical platform.

10. Termination and Amendments

• The Company may suspend or terminate a user’s access to the App at any time if the user violates these Terms or applicable laws, or misuses the App.
• The Company reserves the right to amend these Terms and Conditions at any time. Updated versions will be published in the App or on the website. Continued use of the App after such amendments constitutes acceptance of the updated Terms.

11. Governing Law and Jurisdiction

• These Terms and Conditions are governed by the laws and regulations of the Kingdom of Saudi Arabia.
• Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in the Kingdom of Saudi Arabia.
